Agreement to these terms

These Terms of Use govern your access to and use of PersonalPitch, including the public site, authenticated workspace, campaign tools, AI generation features, Gmail connection features, lead and template management, tracking features, waitlist features, and related services.

By accessing or using PersonalPitch, you agree to be bound by these terms. If you do not agree, do not use the service.

Eligibility and account registration

You must be legally able to enter into a binding agreement to use the service. You are responsible for providing accurate account information, keeping credentials secure, and for all activity that occurs under your account.

If you connect a Google account or Gmail permissions, you represent that you are authorized to grant that access and to use the connected account with the service.

What the service does

PersonalPitch provides tools for creating and running personalized outbound email campaigns, including account onboarding, sender-profile configuration, lead and campaign management, AI-assisted content generation, Gmail-based sending, template reuse, open and click tracking, and unsubscribe handling.

The service is a software tool. It does not become the legal sender of your campaigns, your compliance counsel, or your agent for regulatory purposes merely because you use the software.

Your responsibilities

You are responsible for the data you upload, the campaigns you create, the emails you send, the claims you make in those emails, the leads you contact, and your compliance with all applicable laws, regulations, and contractual obligations.

You must ensure you have the lawful basis, permissions, notices, and suppression practices required for the data and outreach activity you run through the service. That includes responsibility for anti-spam, privacy, consumer-protection, employment, and communications laws that may apply to your use case.

You are also responsible for reviewing AI-generated or AI-assisted output before use. You must not assume generated text is accurate, lawful, non-infringing, non-defamatory, or fit for your campaign without human review.

Email, tracking, and unsubscribe compliance

If you send commercial email through the service, you are responsible for complying with applicable email-marketing laws and standards, including requirements relating to truthful headers, non-deceptive subject lines, sender identification, unsubscribe functionality, and suppression handling where those requirements apply.

You may not use the service to send unlawful spam, deceptive email, phishing, malware, harassment, or any message that violates the rights of recipients or third parties. You must honor unsubscribe requests and maintain suppression practices as required by law and good practice.

If you enable or use open tracking, click tracking, or unsubscribe features, you are responsible for using them lawfully in the jurisdictions relevant to you and your recipients.

Acceptable use restrictions

You may not use the service to violate law, infringe intellectual-property or privacy rights, process data you are not authorized to use, interfere with the platform, reverse engineer protected parts of the service except where law clearly allows it, or attempt to gain unauthorized access to any system or account.

You may not use the service to generate or send harmful, fraudulent, abusive, defamatory, discriminatory, or otherwise unlawful content, or to test stolen credentials, scrape protected systems unlawfully, or route prohibited traffic through connected accounts.

We may investigate misuse and may suspend, limit, or terminate access where we reasonably believe the service is being used in a way that creates legal, security, operational, or reputational risk.

Third-party services

PersonalPitch relies on third-party providers and integrations, including infrastructure, hosting, authentication, AI, queueing, analytics, and Gmail or Google-related services. Your use of those parts of the service may also be subject to the terms and policies of the relevant provider.

We are not responsible for outages, decisions, policy changes, access limitations, or data handling practices of third-party providers except to the extent required by applicable law.

Intellectual property and service ownership

As between you and PersonalPitch, you retain rights you hold in the data and content you submit, subject to the rights needed for us to operate, host, process, secure, and improve the service and to comply with law.

We retain all rights in the service itself, including the software, design, branding, workflows, and related intellectual property, except for rights expressly granted to you under these terms.

These terms do not grant you any right to use PersonalPitch trademarks, branding, or proprietary materials except as reasonably necessary to use the service in the ordinary course.

Feedback

If you provide feedback, suggestions, ideas, or recommendations about the service, you agree that we may use them without restriction or obligation to you, except where applicable law does not allow that result.

Availability, changes, and beta status

We may modify, suspend, discontinue, or limit any part of the service at any time. Features may change, especially while the product is still evolving.

We do not guarantee uninterrupted availability, error-free operation, perfect deliverability, or that generated output will achieve any particular open rate, click rate, reply rate, or business result.

Disclaimers

To the maximum extent permitted by law, the service is provided on an as-is and as-available basis. We disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that AI-generated output is accurate, complete, lawful, original, or suitable for your intended use, and we do not warrant that sending through a connected third-party email provider will succeed, remain available, or meet any deliverability expectation.

Limitation of liability

To the maximum extent permitted by law, PersonalPitch and its operators, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunities, or reputation arising out of or related to your use of the service.

To the maximum extent permitted by law, our total liability for claims arising out of or related to the service will not exceed the greater of the amount you paid us for the relevant service in the twelve months before the claim arose or one hundred U.S. dollars.

Nothing in these terms excludes liability that cannot be excluded under applicable law.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PersonalPitch and its operators, affiliates, and service providers from claims, liabilities, damages, judgments, losses, costs, and expenses arising out of or related to your content, your campaigns, your recipient data, your misuse of the service, or your violation of these terms or applicable law.

Suspension and termination

We may suspend or terminate your access at any time if we reasonably believe you have violated these terms, created legal or security risk, harmed the service or others, or used the platform in a way that is abusive, deceptive, or unlawful.

You may stop using the service at any time. Some provisions of these terms, by their nature, should survive termination, including provisions relating to ownership, disclaimers, limitations of liability, indemnity, and dispute-related terms.

Changes to these terms

We may update these terms from time to time. If we do, we may revise the last-updated date and, where appropriate, provide additional notice. Your continued use of the service after updated terms take effect means you accept the updated terms for future use.
